3. Use of the Site

  • Eligibility: You must be at least 18 years old to use the Site. By using the Site, you represent that you meet this age requirement.

  • Availability: All products are subject to availability. We reserve the right to limit quantities or discontinue products at any time without notice.

5. Orders and Payments

  • Order Acceptance: All orders are subject to our acceptance. We may refuse or cancel any order for any reason, including product unavailability, errors in pricing, or suspected fraud.

  • Payment: You agree to provide accurate payment information and authorize us to charge the total amount of your order, including applicable taxes and shipping fees, to your chosen payment method.

  • Cancellations and Refunds: All items are one-off pieces of art and sold as-is. As such, we currently do not accept cancellations nor returns. Email us (anon@highertrustsociety.com) with customer service requests, which we will consider and resolve on an individual basis.

6. Shipping and Delivery

    • Shipping: We will ship products to the address provided during checkout. Shipping times and costs vary based on location and shipping method.

Shipping Costs: Costs are based on shipping destination and order cost. Orders over $100 are a flat $5 in N. America and $15 International.

  • Risk of Loss: We do NOT cover lost order costs. Risk of loss and title for products pass to you after the order is marked shipped and received by the shipping carrier.

7. Intellectual Property

All content on the Site, including text, images, logos, and designs, is owned by or licensed to us and is protected by copyright, trademark, and other intellectual property laws.

  • You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.

8. User-Generated Content

  • If you submit reviews, comments, or other content to the Site, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, and display such content in connection with the Site.

  • You agree not to submit content that is unlawful, defamatory, obscene, or infringes on third-party rights.

The Site may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of these websites. Accessing third-party sites is at your own risk.

Your data is automatically shared with our private server web host, email client and shipping software.

    • Private Web Host refers to our non-US server

    • Email client is on our private web host but may include a 3rd-party such as Klaviyo or EmailOctopus in the near future

Shipping software refers to Shipstation.com

10. Disclaimer of Warranties

  • The Site and all products are provided "as is" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

  • We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or purchase of products. Our total liability for any claim shall not exceed the amount you paid for the product or service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold us, our affiliates, officers, and employees harmless from any claims, damages, or losses arising from your use of the Site, violation of these Terms, or infringement of any third-party rights.

13. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by and construed in accordance with the laws of Travis County, Texas, without regard to its conflict of law principles.

  • Dispute Resolution: Any disputes arising from these Terms or your use of the Site shall be resolved through binding arbitration in Travis County, Texas, in accordance with the rules of American Arbitration Association or similar association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Termination

We reserve the right to suspend or terminate your access to the Site at our discretion, without notice, for any reason, including violation of these Terms.

15. Privacy Policy

Your use of the Site is also governed by our Privacy Policy.

User Data Deletion: We delete user data on a reoccurring basis after the order is shipped minus your email address.

16. Force Majeure

We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including natural disasters, wars, or governmental actions.
